欧洲毒品和毒瘾监测中心（EMCDDA）的報告已經證實，毒品除罪化正式實施的2001年沒有毒品致死的具體數據。實際2002年毒品致死數為34件，謠傳2001年有75件，因此才有毒品致死率下降100%的說法，但在所附P16已明確指出這種說法沒有根據。此外，從接下來十幾年的跟蹤發現，葡萄牙毒品致死的案例有所增加。
這個說法不實的另一個原因是，葡萄牙在2009年才開始搜集所有非法用藥致死的數據。
